Q7 - Charter of Rights

The Charter of Human Rights and Freedoms Act 2006 has led to courts giving more rights to Victorian sex offenders and less protection to the community. In 2011, the Scrutiny of Acts and Regulations Committee (SARC) recommended repeal of the the power given to judges to interpret all other laws in the light of Charter rights - but this change has not been implemented.

The Charter of Human Rights strikes an appropriate balance between the power of the Parliament to legislate and the requirement for government agencies and others to consider the human rights implications of their decisions. We believe that appropriate balance should be retained.

The Coalition supports the legislative protection of human rights but acknowledges the concerns raised by the Victorian Parliament's Scrutiny of Acts and Regulations Committee following its 2011 review of the Charter of Human Rights and Responsibilities Act 2006. The Coalition will continue to monitor the operation of the Act to ensure it is achieving its intended purpose.
