Q3 - Same-sex marriage

Marriage – the lifelong exclusive commitment between a man and a woman – is of fundamental importance to society as the optimal environment for raising the next generation. Moreover on 12 December 2013, the High Court ruled that marriage is a federal responsibility under the Australian Constitution. Any state or territory law relating to marriage would thus be invalid.

Would you oppose any attempt to legislate for any type of state-based marriage in Tasmania?

The High Court has recently confirmed that the laws relating to marriage are a matter to only be dealt with by the Federal Parliament. On this basis, we will not introduce any Laws to change the Marriage Act.

Australian Labor Party                                                                                            

Labor believes in a gender-neutral Marriage Act at Federal and/or state level. Labor will pursue marriage equality at state level including the recognition of same sex marriages conducted in other Australian and international jurisdictions. Labor recognises that this is a complex and difficult issue and will continue to respect the right of Labor Members of Parliament to exercise a conscience vote.
