Q2 - Same-sex civil unions

In South Australia, the only couple relationship registered by the Registrar of Births, Deaths and Marriages is true marriage – between a man and a woman. Some states have legislated for registered civil unions of couples (including same-sex couples), thereby giving them marriage-like status. The unique status of marriage should be preserved, since marriage provides public benefits as the optimal environment for raising children.

Would you oppose any bill that would legalise same-sex civil unions?

Labor Party                                                                                                    

 The Labor Party received this survey in January but has declined to respond despite repeated requests.  In the past, Labor MPs have expressed support for legalised civil unions as well as same-sex “marriage”.

Liberal Party                                                                                                    

Marriage is a matter for the Federal Parliament.

The recent decision of the High Court overruling the ACT legislation in this regard has restated the law in this regard.  In The Commonwealth v ACT [2013] HCA 55, the High Court overruled ACT legislation and held:

"Under the Constitution and federal law as it now stands, whether same sex marriage should be provided for by law (as majority of the Territory Legislative Assembly decided) is a matter for the federal Parliament."

The Liberal Party in the Parliament of South Australia opposed the Same Sex Marriage Bill 2013 on the grounds that marriage is a matter for the Federal Parliament.

SA Greens                                                                                                    

The SA Greens received this survey in January but have declined to respond despite several requests.  In the past, the Greens have supported legalised civil unions as well as same-sex “marriage".

Stop Population Growth Now                                                                                                    
I support the availability of same-sex civil unions, but these must not be called marriage, as it would offend many heterosexual married couples.

Dignity For Disability sent 10 individual replies but no party reply.  No candidate would oppose same-sex civil unions.


Nick Xenophon Team                                                                                                

Nick Xenophon is not standing for election – he is a federal senator.  His SA upper house candidates John Darley and Connie Bonaros have not replied: John Darley has been supportive of same-sex unions in the past.
