Paid parental leave and baby bonus laws have allowed women whose babies are delivered stillborn after 20 weeks gestation to receive the payments (on average about $9000 paid leave or $5200 baby bonus), even though there is no live baby to care for. A form obtained from the SA goverment's Pregnancy Advisory Centre (abortion clinic) in 2013 advises women who have had abortions after 20 weeks on how to access these payments.

Would you vote to amend the paid parental leave laws in order to abolish access to these payments by women who undergo a late abortion?

Australian Labor Party 

 Payments such as Paid Parental Leave are made by the Labor Government to financially support eligible families on the birth or adoption of a child. Under the legislation, these payments may be paid for a stillborn child, where a medical professional has certified the stillborn child was delivered.

These rules recognise that the unexpected loss of a child late in pregnancy is a devastating outcome for an expectant mother and many families will have already started to purchase equipment in preparation for their baby. It is the Labor Government’s intention to provide these payments for births and stillbirths, but not for terminations of pregnancy. The termination of pregnancythrough a procedure which is not certified by a medical professional as a stillbirth does not qualifythe claimant for Paid Parental Leave and related payments.

This matter was the subject of significant scrutiny in 2010 during the parliamentary debate on Labor's Paid Parental Leave Act 2010. We remain satisfied that the law as it stands does not contain a loophole in relation to this matter and that no change is required.
